Terms of Service

1. Acceptance of Terms

By creating an account or using Pixfino ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may modify these Terms at any time — continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 16 years old to use Pixfino. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• One account per person. Sharing accounts or credentials is prohibited.
• Notify us immediately at [email protected] if you suspect unauthorized access.

4. Credits and Payments

4.1 Credit System

Pixfino uses a credit-based system. Different operations consume different amounts of credits:

• Standard image generation (1024×1024): 1 credit
• High-resolution image generation (4K): 3 credits
• Video generation: 10 credits
• Face swap: 3 credits
• Image upscale: 1 credit

4.2 Subscriptions

Subscription plans are billed monthly and include a monthly credit allocation:

• Free: limited credits to try the platform.
• Basic ($19.99/mo): 300 credits per month.
• Pro ($49.99/mo): 900 credits per month.
• Creator ($99.99/mo): 3,000 credits per month.

Unused subscription credits do not roll over to the next billing period.

4.3 Credit Packs

One-time credit packs are available for purchase. Credits from packs do not expire while your account is active.

4.4 Refunds

If a generation fails due to a system error, credits are automatically refunded to your account. Purchased credits and subscription fees are non-refundable except where required by law. You may cancel your subscription at any time — access continues until the end of the current billing period.

5. Your Content

5.1 Uploaded Content

You retain full ownership of photos and images you upload to Pixfino. By uploading, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service (AI generation, storage, display).

5.2 Generated Content

AI-generated content created through Pixfino is licensed to you for both personal and commercial use, subject to the following conditions:

• You may use generated content in personal projects, social media, portfolios, and commercial work.
• You may not claim that AI-generated content is an unaltered photograph of a real person when used publicly.
• You may not use generated content for deceptive, defamatory, or illegal purposes.
• You may not use generated content to create non-consensual intimate imagery of real individuals.

5.3 Content Restrictions

You agree not to upload or generate content that:

• Depicts minors in any inappropriate context.
• Contains explicit sexual content or nudity.
• Promotes violence, hate speech, or discrimination.
• Infringes on another person's intellectual property or right of publicity.
• Violates any applicable law or regulation.

We reserve the right to remove content that violates these restrictions and to suspend or terminate accounts that repeatedly violate them.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose.
• Attempt to reverse engineer, decompile, or extract the source code of the Service.
• Circumvent rate limits, credit restrictions, or other technical measures.
• Use automated tools (bots, scrapers) to access the Service without written permission.
• Interfere with or disrupt the Service or its infrastructure.
• Impersonate another person or misrepresent your affiliation.
• Resell, redistribute, or sublicense access to the Service.

7. Intellectual Property

The Pixfino platform, including its design, code, logos, and documentation, is owned by Pixfino and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or proprietary technology.

8. Service Availability

We strive to keep Pixfino available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. AI generation quality and speed depend on third-party providers and may vary.

9. Limitation of Liability

To the maximum extent permitted by law:

• Pixfino is provided "as is" without warranties of any kind.
• We are not liable for indirect, incidental, special, or consequential damages.
• Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
• We are not responsible for content generated by AI models, including any inaccuracies or unintended outputs.

10. Indemnification

You agree to indemnify and hold Pixfino harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

• You may delete your account at any time through your account settings.
• We may suspend or terminate your account for violation of these Terms, with or without notice.
• Upon termination, your right to use the Service ceases immediately.
• We will delete your data within 30 days of account deletion, except where retention is required by law.

12. Dispute Resolution

Any disputes arising from these Terms or the Service will be resolved through binding arbitration, except where prohibited by law. You agree to resolve disputes individually and waive any right to participate in class actions. Small claims court actions are exempt from this arbitration requirement.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
